PRESS RELEASE: NEW YORK, Sept. 10, 2014 /PRNewswire/ — A lawsuit filed in New York Supreme Court by Joseph Brun, represented by Lawrence P. Wolf, alleges that Jody Kriss and his company East River Partners caused severe damages and attempted to drive Brun, and other low-income tenants from their homes.
The case is Joseph Brun v. ERP Park Slope, LLC & Jody Kriss, Index No. 158668/2014.
The case claims that work “.. rendered Plaintiff’s Apartment dangerous to inhabit if not completely uninhabitable.” The “Work resulted in the release of heavy and excessive dust” which contained “highly elevated levels of lead[and] asbestos.”
As the complaint further states, “This is not the first time ERP [and Kriss have] engaged in an illegal pattern of misconduct.” In Lewis Pine, et al. v. ERP WEST 86TH STREET, LLC, Index No. 1560662013, which was filed in New York Supreme Court in July 2013, Kriss and ERP allegedly exposed Plaintiffs to “highly elevated levels of lead[and] asbestos…… with the sole goal of driving them from their homes… [and] with a gross disregard for the life, health and safety of plaintiffs and their families.” According to court filed settlement documents, Kriss and ERP paid plaintiffs $1.6 Million dollars in damages.
